PUBLIC OFFER AGREEMENT
for temporary accommodation services
1. General provisions
1.1. This Public Offer defines the terms of the agreement in accordance with Article 641 of the Civil Code of Ukraine and constitutes an official public offer addressed to an indefinite number of persons (hereinafter the “Client”, “Consumer”, “Guest”) to conclude an agreement for the provision of temporary accommodation services under the terms set out below.
1.2. Hereinafter in this Public Offer, the Hotel and the User together are referred to as the “Parties”, and separately as a “Party”.
1.3. Each Party warrants to the other Party that it has the necessary legal capacity and capacity to act, as well as all rights and powers required to conclude and perform this Agreement.
1.4. The text of this Public Offer is published on the official website of the Hotel: http://hoteljupiter.ua.
1.5. The User consents to the transfer of information to third parties arising in connection with the performance of this Agreement and the receipt of Hotel services by the User, to the extent necessary for the provision of such services.
2. Subject of the Agreement
2.1. The subject of this Agreement is the provision by the Hotel to the User, for a fee, of temporary accommodation services by providing a room (place) for temporary residence at the Hotel’s address: Odesa, Henuezka Street, 3B, in a specially equipped residential unit (room), in accordance with the booking conditions.
2.2. The Agreement is deemed concluded and becomes legally binding from the moment the User accepts this Public Offer in accordance with Article 642 of the Civil Code of Ukraine and is equivalent to a written agreement signed by the Parties.
3. Procedure for concluding the Agreement
3.1. The Agreement is concluded as an adhesion contract.
3.2. Acceptance of this Public Offer is deemed to be the performance by the User of any of the actions specified in clause 3.4 of this Agreement.
3.3. Acceptance of the Public Offer means full, unconditional and unreserved acceptance by the User of all terms of this Agreement without any exceptions or limitations.
3.4. Acceptance of this Public Offer is considered to have taken place when the User performs one or more of the following actions:
- payment for temporary accommodation services (in cash, by payment card or by bank transfer);
- actual use of Hotel services (check-in);
- completion of a registration form (guest card) at the reception desk.
3.5. The User undertakes to provide accurate personal data when registering and receiving Hotel services.
3.6. This Public Offer is of indefinite duration.
4. Payment procedure
4.1. Hotel services, including additional services, are provided to the User on a paid basis in accordance with this Agreement and the rates indicated on the Hotel’s website or information boards, taking into account the selected room category.
4.2. As a general rule, the right to receive and use Hotel services is granted after payment for the relevant services. The Hotel may, at its discretion, provide services without prior payment.
4.3. The Hotel has the right to apply flexible prices and a system of discounts for temporary accommodation services.
4.4. Payment for services at the Hotel may be made in cash, by Visa or Mastercard payment cards, or by bank transfer.
4.5. The Guest must vacate the room and remove all personal belongings and luggage by 12:00 (Kyiv time) on the last paid day of stay, or pay for an extension of the stay if the room is not reserved by third parties.
4.6. Check-in time at the Hotel is from 14:00 (Kyiv time).
4.7. Early check-in and late check-out are additional services and are charged separately according to the Hotel’s rates.
5. Check-in procedure and early termination of services
5.1. As a general rule, the User is checked into the Hotel upon 100% prepayment of accommodation services and presentation of a valid identity document. For persons under 16 years of age, a birth certificate is required.
5.2. In case of the User’s refusal of a booked service or a change in the period of stay for reasons beyond the Hotel’s control, after payment has been made, a fee is withheld in the amount of one night’s stay.
6. Force majeure
6.1. In the event of force majeure circumstances (war, natural disasters, fires, epidemics, changes in legislation, etc.), the Parties are fully or partially released from liability for failure to fulfil obligations under this Agreement.
6.2. The Party for which it has become impossible to perform its obligations must notify the other Party in writing of the commencement and termination of such circumstances.
6.3. Force majeure circumstances must be confirmed by a competent authority.
7. Accommodation of children
7.1. Accommodation of one child up to and including 7 years of age without providing an extra bed is free of charge.
8. Additional Hotel services
8.1. The Hotel provides the following services free of charge:
- room cleaning;
- luggage storage;
- calling emergency services;
- use of an iron and ironing board;
- wireless Internet access;
- TV channels.
8.2. Other additional services are provided at an extra charge in accordance with the Hotel’s rates.
9. Rights and obligations of Users
9.1. Users have the right to:
- use the Hotel’s services and additional services;
- receive complete and accurate information about the services;
- submit comments, complaints and suggestions.
9.2. Users are obliged to:
- comply with the terms of this Agreement;
- observe the house rules and generally accepted standards of behaviour.
10. Rights and obligations of the Hotel
10.1. The Hotel shall:
- provide services in a timely, proper and complete manner;
- ensure that the services comply with sanitary standards;
- promptly eliminate malfunctions in the rooms.
The Hotel is not liable for money, belongings or other valuables left by the Guest outside the safe.
10.2. The Hotel has the right to:
- enter the room for cleaning and technical maintenance;
- terminate the Agreement early without refund in case of gross violation of the house rules;
- refuse check-in to persons without documents, persons under the influence of alcohol or drugs, or if the number of occupants exceeds the maximum allowed for the room.
11. Liability of the Parties
11.1. In case of breach of obligations under this Agreement, the Parties shall be liable in accordance with the applicable laws of Ukraine.
11.2. Disputes arising between the Parties shall be resolved through negotiations, and if no agreement is reached, in court.
